If your company not informed USCIS and you are again working with the same company means you are not out of status, consider 1 month as unpaid vacation. No need to stamp your visa, if you have time in I-94. If you want to go to home country, better go after having atleast 3 /6 months of continuous pay stubs with you

Hi

I have an urgent query. Please help.

I was laid off from my company AA during last week of March-2010. I have not yet singed the lay off letter. And I was rehired by the same AA company on second week of May. I have valid I 94 for next 2 years. But my visa got expired. I was out of payroll for a month. I dont have last 2 payslips.

I have joined the new client through the AA company few days before. My AA compay is asking me to go my Home country and get my Visa stamped and come back. Is there a way that I can continue the employment here without travalling to my Home country at this point ? Are any other better solutions / ways.

Immediate response highly appreciated.

My friend got EAD.His wife is on F1 visa.If he starts using EAD instead of applying for H1 extension, Can he able to join his wife to his GC process who is currently on F1 when his priority date become current.His priority date is Sept06.140 Approved.july 2, 2007 filer.485 is pending.

I got the same kind of RFE , but the wage paid to me is much more than the proferred wage all along . But USCIS wants my company to prove that they have the ability to pay all the pending 140s .. Do you guys think I am Safe?

Can I retain PD (Aug 2003) of EB3 labor application filed with Employer 1

Now I have PERM approved in EB2 with employer 2

Unfortunately, a 212(a)(3)(B) finding would also prevent you from getting a GC based on your marriage to a US citizen.

You are entitled to renewal of your EAD as long as your GC remains pending.

You are on AOS PENDING status. Since u've a valid H1 stamped in ur passport, you are free to roam in-and-out of the country without any issues.

Your H-1 will be invalid until your 485 is approved or you use EAD to work or AP to re-enter US.

I’m confused about using the EAD. Someone please clarify me….

I already received the EAD for me and my wife. Currently, I’m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
•Can I be in H1b and still work another job as a part-time?

------ if the part time job is using a part time H1 only then you will be H1 and dependents in H4 using EAD meaning you lose H1/4
•If my wife wants to work using her EAD does it have any effect on her h4 status?
--- her status becomes AOS pending and H4 is gone
•If my wife loose her job during the use of her EAD what will be her status?
--- she will reamain AOS pending same as while using EAD
•I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
---- you can be self-employed and have similar job description and LC
•I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?
----- if you enter using H1 then it will be H1. the debate is still on whether using AP to enter causes you to lose H1 or not. It is possible to extend H1 status though.
It will be very much appreciated if some can answer my questions?

Hi,
I am also in the same scenario. Filing I-140 and I-485 concurrently. My company's immigration attorney said that while filing for I-140 and I-485 concurrently, we can have the I-140 done in premium processing. And that is how they are filing for me now

If I am not wrong, you must be paid by your consultant. So, those missing days should be a working days as per your consultant is concerned. I work on site too. when there is holidays that my consultant doesn't approve, Consultant pay for those missing days. I am not sure how your consultant is going to utilize you for those missing days. Talk to your consultant, they should be able to help you. Good luck

I believe you have to be in the US when your 140 is applied. Same goes for 485. Check with your lawyer. Once 140 or 485 is applied, you can travel outside.

I'd like to make sure that it was successfully received by processing center. Do you think it is polite to ask my company lawyer for this receipt or since she told me that it was filed I should just sit and relax...:rolleyes:

I'm not sure of the file format. I can't remember off the top of my head which type an eps doc is. I can say that swift will import any illustrator shape, or stroke. I think as a default it gives the object a 1.0 thickness.

If you have Flash, but no illustrator, no worries, because Flash will export any simple construct fills or strokes as a basic illustrator format.

I do almost all of my work in swift with imported shapes. (though the lathe and extrusion editors in swift are nice also)

I am on my H1B 6th Year Ending and my H1B valid till 2012 Sep 30 with my Current employer company A Which is a desi consultancy company.

I have a approved I140 with company A. With PD of March 2008. I 140approved in OCT2008
Cargability - India
I485 - Not yet filed:o
----------------------------------------------------------
on March 1st company A announced that they will be merging with company B.

Company B Sent us an E-mail saying that they are acquiring resource group of company A.

:confused::confused:

When we questioned our old employer company A, they told us that yes company A will remain in existence but all human resources will move to company B :mad: All other assets and liabilities will stay with company A.

I am in lots of confusion...and questions...heap of troubles it seems...
Please tell me

1. This Situation can be called/categorized as Aquisition/Merger?
2. Will my I140 quilified for Successor of Interest if company B is ready to take over and sponcer GC for me?
3. Or do I need to go thru the whole process of ADS, PERM, I140 path to come to current state?
4. What happens if my PDate (Old, and assuming that in either case I can port my PD??) is current before company B's I 140 got approved? Can I file I 485 based on my company A I140 As company A still exists???
Are there any complications involved in this?

5. I am assuming that I am qualified to entitile 3 Year H1B visa with company B based on my company A approved I 140. am I correct?

6. What happens if company A is going for bankruptcy before my H1B transfer?

7. What happens if company A is going for bankruptcy before my I140 approved with company B and port I140 PD?

8. also I heard that Company A may required to pay some amount to the employees(20K ??)? Any idea on this?

Congradulations again to all those IV memeber who are getting Green card approvals and goodluck to all those members who are able to file their I485 and get EAD, just to be out of H1B /H4 clutches and one more step closer to green card

As current drastic visa movment proved the fact that for IV members main issue is not current law but itz implimentation. a change in law will certainly help, but thatz not our big problem

I would like to discuss your IV future agend with current situation, Please post your opinion how you think IV should procede based on current situations.

I belive IV should now concentrate more on making sure current law is implimented in a more effeciant way, make sure USCIS does not waste any visa numbers, we need to push for speeding citizenship processes and makeup for loss time during retrogression

IV should stop chasing CIR which has nothing for us and itz very controversial

IV is for legals and we should concentrate only on whatz good for us

I really appreciate core members opinion

I have PD which is current (Jun 03 EB2 India), a RD which is current (Jun 05! yes VSC transfer to TSC in Apr 07). In the last week of Nov 07 got a simple RFE (medical RFE wherein the doc forgot to check one box), which was replied promptly and got confirmation from USCIS that they got the response.

Have been following up with USCIS (service request, POJ-TSC from April 7th). Got a soft LUD today (04/22/2008). does it mean anything ?

I have an h1b and EAD. i am employee of company A. currently i am working for a client(a startup company) in project through company A.. now this client wants to give me some equity(shares) of his company. i will keep on working as company A's consultant with this client.

my question is can i take the equity(shares) of my client. ofcourse he is not paying me anything, my paycheck still comes from company A as i am there h1b employee.

just wanted to make sure taking equity wont hurt my h1b ??

When you file for a transfer to company C, the USCIS will see if the H-1 with company B was approvable or not before they agree to approve the H-1 with C. You have essentially created a bridge by filing the H-1 with company B. The USCIS has said that they would allow bridge petitions, however in order not to complicate things, i would convert company B H-1 to PP get the approval work for 1 month, get a paystub and then file a transfer.

The only problem is that she started working from Jan 2008. From Oct 2007 to Dec 2007 she was not working. So I donot have her W2 and neither the paystubs. I do have the joint tax return that I filed in 2007, but that does not have her income. Is it possible to say that she was on leave during this period for personnel reason?

I just checked the copy sent to me from my law office. It says I-485 pending for the current status. I got the EAD renewed without any problem.

I saw somewhere that you can alos write AOS pending.
